A new ruling by the German Federal Court of Justice states that subletting an apartment is not allowed to generate profit. The court decided that subletting should only cover costs, preventing landlords from exploiting the housing shortage for profit. The government is also planning stricter regulations on furnishing surcharges to close loopholes in rent control.

So, if we turn it around again, what is allowed after this ruling if you want to sublet your apartment?

Ich brauche eine Erlaubnis als Mieter, der die Wohnung untervermieten möchte, und zwar eine Erlaubnis vom Vermieter.
As a tenant who wants to sublet the apartment, I need permission, specifically permission from the landlord.

Das ist ganz zentral. Ich habe aber einen Anspruch auf diese Erlaubnis, wenn ich ein sogenanntes berechtigtes Interesse habe.
That is very important. However, I have a right to this permission if I have a so-called legitimate interest.

Und für dieses berechtigte Interesse gibt es eigentlich drei große Fallgruppen.
And there are actually three main categories of cases for this legitimate interest.

einmal ich gehe vorübergehend ins Ausland, dann ich habe mich zum Beispiel, wie gerade schon gesagt,
Firstly, I am going abroad temporarily, then, for example, as I just said,

Er hat sich darauf gestützt, dass er die Wohnung ja voll mobiliert überlassen hat, dass da teils hochwertige Möbel drin gewesen seien.
He based his argument on the fact that he had handed over the apartment fully furnished, that there were partly high-quality furniture in it.

Da hat der Bundesgerichtshof aber gesagt, ob die jetzt hier drin waren und ob er dafür einen gewissen Zuschlag hätte verlangen können, das spielt gar keine Rolle.
However, the Federal Court of Justice said that whether it was there or whether he could have charged a certain surcharge for it, that doesn't matter at all.

Weil jedenfalls das, was er verlangt hat für die Wohnung, so hoch war, dass er damit einen Gewinn gemacht hat.
